Please help! Someone stole money from me and filed a bankcruptcy. Should I file a proof of claim?

Absolutely. Now it will depend on what type of bankruptcy this person files for. If they file a chapter 13, then it is a (re-payment) plan that they must pay back all the creditors, but will (not) get back all, but will end up with some vs none. But if they file a chapter 7, then it discharges all the debts. But like the others stated, do you have proof of the theft vs a loan?

Yes, you should file a proof of claim. But this only makes you a creditor. However, if they really stole money from you, then this a criminal case and you should call the police. If it's found that he did steal the money, it can't be discharged with a BK. You say he stole the money from you. There is a difference in stealing and owing you money that he hasn't repaid using BK. Without more facts, it's impossible to help more.

Yes and you should also file a motion to declare the debt not dischargable.

Do you have roof they stole money?

Face, you aren't likely to get much back. How much did they steal? Decide if it's worthwhile trying to pursue it. Have you proof, file a police report. maybe you can at least make their lives more miserable.

All you can do is file a petition for payment with the bankruptcy courts.
