You legally owe the landlord the rent - failure to pay risks eviction, which will also make it difficult to rent again.

Don't sign a lease that you can't honor. If you do, then you will be evicted and then you won't be able to rent anywhere else, after they sue you. Your record will follow you.

You will be given a notice after the 5th of the month to pay (along with applicable late fees) OR vacate by a certain date, so they can hurry up and re-rent your unit to someone else. But you don't actually have to leave at that point. If you are unable to pay, an eviction will be processed through the court and you will have to move out by the date they set. The eviction will be on both your rental history and probably credit report for years and will hinder your future rental options. Also, if evicted, you will be responsible for the court processing fees and possibly the additional length of time you stayed in the property. Always communicate up front with your landlord, because at the end of the day, it is their decision to work around your issue or not.

there is no world wide rule about the 5th. in NJ, they don't even have to give notice, they can file in court as soon as you fail to pay rent. most states require a pay/cure or quit notice that varies from 3-7 days to come up with the money...if you don't LL can file for eviction in court. you can be issued the pay or quit notice when rent is 1 day late (ie on the 2nd). even if your lease gives you a grace period to the 5th, in some states, LL can still issue a pay or quit on the 1st and file for eviction on the 6th.
